Terms & conditions
The terms that apply to our quotes, agreements and works.
1. Definitions
In these terms, ‘we’ or ‘Premium Houses’ means the premium label of Tommy’s Service (KvK 62541536); and ‘client’ means the natural or legal person with whom we enter into an agreement.
2. Applicability
These terms and conditions apply to all quotes, offers, agreements and works of Premium Houses, unless agreed otherwise in writing.
3. Quotes and offers
All our quotes are without obligation and based on the information provided by the client. A quote is valid for the period stated therein.
4. Formation of the agreement
The agreement is formed after written acceptance of the quote by the client, or when we start the work.
5. Execution and planning
We carry out the works to the best of our insight and craftsmanship. Stated schedules and deadlines are indicative; exceeding them gives no right to compensation, unless there is intent or gross negligence.
6. Prices and payment
Unless agreed otherwise, we work with fixed price agreements and invoicing per phase. Payment must be made within the term stated on the invoice. In case of late payment we may suspend the works.
7. Additional work
Changes to the assignment or additional wishes that result in extra work are discussed in advance and, after approval, charged separately.
8. Delivery
The work is considered delivered after a joint final inspection and approval by the client, or when the client actually takes the work into use.
9. Warranty
We stand for the quality of the delivered work. The statutory and any additionally agreed warranty periods apply to works and materials.
10. Liability
Our liability is limited to the amount paid out by our insurance in the relevant case, or to the amount of the assignment. We are not liable for indirect damage.
11. Force majeure
In the event of force majeure we are entitled to suspend execution without being liable for compensation.
12. Complaints
Complaints about the execution must be reported to us in a timely manner and in writing, so we have the opportunity to assess and resolve them.
13. Applicable law
Dutch law applies exclusively to all our agreements.
